Our most successful April Seminar included an extensive presentation by member Jerry Hiatt on several important issues raised in his $2.1 million judgment case against Infinity/Nissan. Available for those who are interested are the jury instructions, as well as Judge Victoria Marks' Findings of Fact, Order and the Judgment in which she granted a two-times multiplier of Jerry's lodestar fees (from $354,324.00 to &708,649.00, plus $76,346.00 in costs and $32,655.00 in taxes, based on an approved hourly rate of $260.00), in recognition of the contingency nature of the case as one of the enhancement factors, citing the recent Chun et al. v. Trustees of ERS, State of Hawaii (2/2/2000) case, among many others. Copies of Jerry Hiatt's fee motion and exhibits are also available.

In addition, Federal Judge Alan Kay's Order of 3/10/2000 which awarded significantly increased attorneys' fees ($165 - $275 per hour for attorneys of varying experience; $85.00 per hour for a senior paralegal) and costs (allowing the inclusion of costs for interisland travel, faxing, investigations, experts, computer aided legal research, and video clips used as exhibits) to the Davis & Levin firm in the Terence B. Allen , M.D. employment case against the administrators of the Department of Public Safety, is also available. This Order extensively discusses and revises the applicable standards, as originally applied by Magistrate Judge Yamashita.

Finally, additional copies of the Seminar manual, which includes the Nissan expert witnesses disputed testimony, Professor Randy Roth's and all of the other presenters' materials are available, as are audio tapes of the presentations.
